The terms “We” / “Us” / “Our”/”Company” individually and collectively refer to “Cloudplayy” brand name and the terms “You”/ ”Guest User”/ ”Registered User”/ ”Subscribed User”/ “User” refer to the visitors, users, customers and others who access or use our service. This page provides the Terms & Conditions which govern your visit, browsing through or playing games on our website.

You should visit this page on each login and periodically to  re-appraise yourself of the terms & conditions. 

Your continued use of our website after any modification to these policies will constitute your acknowledgement and consent to accept and abide by the modified privacy policy.

4. Eligibility

By using our services as a guest, or registering for or subscribing to or by accessing/using our Service, you represent, warrant and expressly agree that you are an adult, and that you will be responsible for ensuring that any child/children authorized by you to use and access our Services does/do so in accordance with these terms & conditions. Our services are available only for users who have reached legal age in their jurisdiction or receive proper parental consent and guidance while accessing this website. Our service and its original content, features and functionality are and will remain the exclusive property of Cloudplayy and its licensors. You shall not sell any product or services on the website. You shall not copy, modify, reproduce, upload, display, distribute any material/document/picture or any material in any format whatsoever on this website for any reason whatsoever.

6. Indemnity

The user unilaterally agree to indemnify and hold harmless, without objection, the Cloudplayy, its company, officers, directors, owners, employees or agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their user of Cloudplayy services or their breach of the terms.

7. Liability

a). You agree that neither Cloudplayy, its company nor its associates, affiliates, officers, directors, employees or agents shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and any damages, resulting from use or/and liability to use service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from service or/and resulting from unauthorized access to or/and alteration of user’s transmissions or/and data or/and arising from any other matter relating to the service including but not limited to, damages for loss of profits or/and user or/and data or other intangible, even if Cloudplayy has been advised of the possibility of such damages. 

b). You agree that neither Cloudplayy, its company nor its associates, affiliates, officers, directors, employees or agents shall be liable for any damages, resulting from the use of Third Party services available to you on the website.

c). You agree that neither Cloudplayy, its company nor its associates, affiliates, officers, directors, employees or agents shall be liable for any damages arising from interruption, suspensions or termination of service, including but not limited to direct/indirect/incidental/special consequential/exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

d). You agree that neither Cloudplayy, its company nor its associates, affiliates, officers, directors, employees or agents shall be liable to you, your legal heirs or representative(s) or anyone, for statements or conduct of any party for the service provided on our website. We reiterate, under no circumstances whatsoever shall Cloudplayy’s total liability to you for any loss, damages, costs, penalty, of any other amount in whatever name shall exceed the amount paid by you to Cloudplayy, if any, for visiting, using, or playing games on our website.

8. User Account & Registration

Cloudplayy services can be availed only after creating an account (“”registered user”). To become a registered user, you will be required to sign up and create your user account which will contain personal information including your mobile number. You will be asked to verify your email address. When registering or creating an account on our website, you represent that: (a). All information you submit is truthful, current, complete and accurate and; you will maintain the accuracy of such  information. (b). Your use of Cloudplayy services is not against any applicable law or regulation in your jurisdiction and in our jurisdiction (India). (c). You have read, accept and agree to our terms & conditions.

We can terminate your account and your use of our services without any refund at any time without notice if we detect prohibited activities, or any violation to our terms & conditions by you and we shall not be liable for any loss or damage to you or any third party arising out o such termination.

You are responsible for the confidentiality of your identifiers and password, as well as the security of your computer equipment and system. You can delete your user account by contacting us. 

9. Fees & Payment terms

Cloudplayy services can be availed only by registered user. We have kept the rates for using our services quite simple on a per-hour basis. You need to add balance to your user wallet to avail the gaming services and are subjected to receiving the amount using the payment methods available on our website. We will not be responsible for any failed payment transactions and it will be your responsibility to check the same with your bank. Cloudplayy may, in its sole and exclusive discretion, immediately suspend or terminate your services without notice to you if Payment Process fails. You understand and agree that you are responsible for any and all network bandwidth, compute, hard-drive usage, and any other overage charges you incur for using our services, even if such overages arise because your account is compromised or “hacked”. 

User is responsible for the security of bank cards and payment instruments ( including bank account number/credit card/debit card/UPI id details) used for transactions on our website. We will not be responsible for any unauthorized card use or fraudulent activity. User also need to understand and acknowledge that we only facilitate the third-party payment gateway for processing or payments. Such third-party payment gateway service providers will require certain financial information including your credit card/debit card or other banking information. Other than providing confirmation upon receipt of payment, we disclaim any and all liabilities in relation to your payment processing by such third-party payment gateway service provider and the collection and processing of any information provided to third-party payment gateway service provider. While using such payment gateways to make payment to us, you will be abided by the user agreement/terms of use and privacy policies of such payment gateway service providers. We request you to please make yourself familiar with the user agreement/terms of use and privacy policies of your respective payment gateway service provider before using such service.

10. Cancellation and Refunds

Cloudplayy reserves the right to cancel the account at any time. We do not give any money back guarantee for our services. If the user wish not to continue with our services, and have balance left in their wallet, they may contact us. Cloudplayy will check and decide whether to refund or not based on its sole discretion without any liability. If Cloudplayy have suspended or terminated your services because we detect prohibited activities, or any violations to our terms & conditions by  you, no refund will be provided at all.

Users acknowledge that no compensation or refund requests will be entertained in the event of dissatisfaction with our services, hardware incapacity to maintain seamless operation, unmet expectations, or discrepancies from advertised functionality.

11. Games available through Cloudplayy

Cloudplayy is a gaming service provider, not a content provider, so you can only run the games that you already own. You will not be able to run a game if you haven’t bought it from official digital distribution platforms. When you run a game on our website you must comply with all applicable third party rules related to the use of this game.

Please check the list of games available on our website before you pay for it. We further do not guarantee availability of any particular game on our website. Games that are available now may become unavailable at any time without notice. 

12. Prohibited Activities

a). You cannot sell or modify the content of Cloudplayy services or reproduce, display, distribute or otherwise use the materials in any way for any public or commercial purpose. We hold the rights to add/remove/replace/change any games offered at its discretion, without having to infirm the user prior to the changes.

b). You are prohibited from violating or attempting to violate the security of Cloudplayy services, including, without limitation, (i)accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentications measures without proper authorization, (iii) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or “”trojan horse” to our website, overloading, “flooding”, “mail bombing” or “crashing”, or (iv) sending unsolicited email, including promotions and/or advertising of products or services, (v) use our website or servers for mining cryptocurrency. Violations of system or network security may result in civil or criminal liability. Cloudplayy reserves the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

c). Users may not use Cloudplayy services in order to transmit, distribute, store or destroy material (i) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (ii) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (iii) that is libelous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful. If any user is found installing any external softwares including games on the servers, that account will be permanently banned and terminated without the claim for any refund.

d). Users shall not use our services for unlawful or prohibited purposes. Users agree not to attempt, through any means, to gain unauthorized access to any part of our services, user accounts, computer system or network connected to our servers. We monitor all activities on our services for security and other purposes.

e). Without limiting the foregoing, user will not use our service to: (i) violate applicable local, state, national, international or other law, rule, regulation, court order; (ii) access/use of or services from territories where it or its content is illegal or prohibited; (iii) promote criminal or illicit activity, provide information about illegal activities; (iv) use our website to transmit, distribute, post or submit any information concerning any other natural or legal person without their permission; (v) harvest or collect email addresses, other contact information of other users by electronic or other means; (vi) promote racism, bigotry, hatred or physical harm against any group or individual, “stalk” or harass other users or collect or store information about other users; (vii) access or attempt to access any functionality, software, data, information or part of our website through means not intentionally made available through our website; (viii) register for a user account on behalf of an individual other than yourself or register for more than once active user account; (ix) transfer, sell user account to another person/people, share your account with others; (x) impersonate any person/entity, falsify or otherwise misrepresent yourself or your affiliation with any person/entity; (xi) use automated scripts to access, search, collect information or otherwise interact with our website (including without limitation robots, spiders or scripts) or use any robot, spider, other automatic device, or manual process to extract, “screen scrape”, “monitor”, “mine”, or copy any static or dynamic web page on our website or the content contained on any such web page for commercial use or otherwise; (xii) other than with respect to your own user content, use, reproduce, duplicate, copy, stream, sell, resell or exploit the content; (xiii) decipher, decompile, disassemble, reverse engineer our website or software, or otherwise attempt to derive any source code or underlying ideas or algorithms; (xiv) modify, translate, or otherwise create derivative works; (xv) launch more than one streaming session (gaming session) under your account; (xvi) advocate, encourage or assist any third party in doing any of the foregoing.

f). Any threatened or actual breach of any of the provisions of this clause shall immediately and automatically, without any prior notice, lead to suspension of your account and termination of your subscription without any claim for refund towards the subscription paid by you.

13. Privacy Policy

a). Cloudplayy is committed to protecting any data that we collect concerning you. By using our services you agree to the use of the data that we collect in accordance with this privacy policy. All possible measures, steps & procedures are adopted to stay-put towards the India Data Protection Legislation.

b). We do not provide the information collected from you to any third party for any reason. However, we do have to cooperate with law enforcement agencies authorized by the government if they do ask us about the contact details we have for you.

c). Information Use: This information is used for billing and to provide service and support to our customers. We may also study this information to determine our customers needs and provide support for our customers. All reasonable precautions are taken to prevent unauthorized access to this information. This safeguard may require you to provide additional forms of identity should you wish to obtain information about your account details. Cloudplayy may email its newsletters to the user’s primary contact email.

d). Cookies: Your Internet browser has the in-built functionality for storing small text files – “cookies” – that hold information which allows a website to recognize your account. We use cookies to save your preferences and login information, and provide personalized functionality. You can reject cookies by changing your browser settings, but be aware that this will disable some of the functionality on our website.

e). We use IP addresses to analyze trends, administer our site and servers, track access, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. It is possible that personal information about a customer may be included in the log files due to the normal functions of IP addresses and web browsing.

f). We do not disclose any personal information obtained about you from this website to third parties. We may use the information to keep in contact with you and inform you of developments associated with our service.

g). You will be asked to provide your email address to us during the registration process to be able to communicate with you and we also ask you to provide us with your actual postal address, mobile number & fax number in order to check and verify the distance between the address mentioned & the location of registration. This is an important part of the verification process we follow for each signup which we receive. Normally we send all our notifications through emails which we have for your account on our record.

14. Backups and Data Loss

Your use of the service is at your sole risk. Cloudplayy is not responsible for files and data residing on your account**. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on AntPlay servers.
Cloudplayy automatically generates backups of all machines once every 24 hours, with weekly off site backups. Dedicated servers are not automatically backed up or protected. If loss of data occurs due to an error of AntPlay, we will attempt to recover the date for no charge to the client. If data loss occurs due to negligence of a client in securing their account or by an action of the client, AntPlay will attempt to recover the data from the most recent archive for an extra fee.

15. Force Majeure

Cloudplayy will not be liable for any failure or delay in its service performance under this agreement due to any cause beyond its reasonable control, including, but not limited to, acts of war, acts of God, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act or failure of the Internet.

16. Miscellaneous

Cloudplayy reserves all rights not expressly granted by these terms. These terms shall be governed by and construed in accordance with the laws of India. Unless otherwise determined by the applicable law, in the event of any dispute, the courts or other relevant authority located in Agra (Uttar Pradesh, India) shall have exclusive jurisdiction. We may transfer, assign or delegate our rights to our affiliates and other third parties. Wherever possible, each provision of these terms shall be interpreted in such manner as to be effective and valid under applicable law. If any term, provision, covenant or restriction of these terms is held by a court of competent jurisdiction to be invalid, illegal, void or unenforceable, the remainder of the terms, provisions, covenants and restrictions set forth herein shall remain in full force and effect and shall in no way be affected, impaired or invalidated, while such term, provision, covenant or restriction shall be deemed reformed to the extent necessary to conform to applicable law and to give the maximum effect to its initial intent. Our failure to exercise any right or provision of these Terms will not operate as a waiver of such right or provision.
